Steps to Take after an Oklahoma Car Accident

By Maples Law Firm on July 19, 2012 - No comments

Have you thought about what to do if you are ever involved in an Oklahoma car accident? The steps you take immediately following the collision can affect your ability to pursue compensation for your injuries, damages, and losses in the future.

First, check yourself, your passengers, and the other parties involved in the crash for injuries. If anyone has suffered an injury, you are legally required to contact the authorities right away. If your neck, back, or head hurts, you may want to stay where you are and wait for help. If you are capable of moving around without suffering further injury, you should begin collecting information that can be very important during the claims process.

Be sure to get the name, contact, and insurance information from the drivers involved in the crash. Collect the contact information from anyone who may have witnessed the collision as well. If you have a camera, or a phone that takes pictures, photograph the crash site, the vehicles, tire marks, and your injuries. Also, write down where, when, and how the crash occurred.

When the authorities arrive, get your account of the incident into the police report. If police do not arrive, file a report at the station as soon as possible. Next, you should seek medical attention. Seeing a doctor promptly will increase your chances of a full recovery. Additionally, your medical records can serve as legal proof of your injuries.

If you have suffered a serious injury, or you worry that the at-fault driver will refuse to accept blame for the incident, please contact the experienced Oklahoma City auto accident injury attorneys at Maples Law Firm. Bartlesville Head-On Collision Causes Injuries

By Maples Law Firm on June 20, 2012 - No comments

Two Bartlesville residents were injured in an Oklahoma car accident involving a head-on collision. According to a KJRH news report, the head-on collision occurred on Price Road in Bartlesville. Officials say a northbound Mercedes SUV went left of center and crashed head-on into a Mitsubishi Galant. The woman, who was in her 70s, was driving the Mitsubishi and suffered injuries to her leg and chest as well as lacerations to her arms as a result of airbag deployment. The male driver of the Mercedes, a man in his 30s, suffered a head laceration. It is unclear if the driver of the Mercedes will face citations for crossing into oncoming traffic.

Under Oklahoma Statute 11.311: “Whenever any highway has been divided into two or more roadways by leaving an intervening space or by a physical barrier or clearly indicated dividing section so constructed as to impede vehicular traffic, every vehicle shall be driven only upon the right-hand roadway.” Drivers who let their vehicles drift into oncoming traffic may be held liable for the damages they cause.

A driver does not have to be cited for a collision to be held civilly responsible for the victim’s losses. Victims of Oklahoma car accidents only have to prove that the at-fault party was negligent at the time of the collision. Examples of driver negligence include: exceeding the speed limit, fatigued or drowsy driving, driving while distracted, and failing to stay within a lane of traffic.
