Types of Nursing Home Neglect
Most nursing homes do their best to provide care that allows their residents to enjoy the highest quality of life possible in their remaining years. When a nursing home is under-funded or under-staffed, however, neglect can occur, and serious injuries or illnesses can result. Those injured or the families of those who pass away due to the negligence of a nursing home staff have the legal right to pursue compensation for their losses. Oklahoma nursing home neglect lawyer Ray Maples can aid you in your search and apply their years of success to your case.
Types of Oklahoma Nursing Home Neglect
Unlike abuse, which involves improper acts taken by a caregiver that harm an elderly person, neglect usually involves a caregiver not doing something that an elderly person needs. Common types of nursing home neglect include:
- Failure to help a patient perform basic bodily functions, like eating, drinking, or using the bathroom. Signs of this type of neglect include malnutrition, dehydration, and evidence that the elderly person has soiled himself or herself.
- Failure to move a patient who is unable to move on his or her own. The most common result of this type of neglect is bed sores, which form when the body is in contact with a bed or chair for a long period of time without moving, and which can cause serious damage.
- Failure to meet the elderly person's personal hygiene needs. This form of neglect shows up as bad body odor, soiled clothing or bed linens, tooth decay, tangled or matted hair, and other problems. Poor hygiene can also easily lead to infections or injuries.
- Failure to protect an elderly person from falls. The fall risk for elderly adults is highest of any age group, according to the U.S. Centers for Disease Control and Prevention (CDC). Nursing home residents are at an especially high risk of falls because they often have limited mobility. Nursing home staff should always be aware of fall risks and should not use restraints to prevent falls, since the CDC notes that restraints are not usually effective in preventing falls and may cause other problems.
- Failure to protect an elderly patient from abuse. Nursing home staff is required in Oklahoma and other states to report suspected abuse, whether it's being perpetrated by another staff member, another resident, or a family member or friend of the elderly person. Failing to report suspected abuse is a type of neglect.
- Failing to respond when a patient needs help. This includes ignoring call lights or bells, ignoring calls for help, or failing to accommodate reasonable and necessary requests made by nursing home residents or their loved ones.
Nursing home neglect can cause serious injuries. Bed sores, for example, may cause permanent damage or even death, either from the advancement of the sores themselves or from infection caused by their presence. Falls often result in fractures that can lead to death or to restricted mobility, severely reducing an elderly person's quality of life and ability to maintain health.
In many cases in Oklahoma, nursing home neglect has proven just as dangerous. Often nursing home companies are guilty of cutting corners and understaffing, thus leading to neglect. Other times, individual staff members are neglectful, and companies do not supervise them properly. Our OKC nursing home abuse lawyers at Maples Injury Law handle cases involving the failure to provide for basic needs, which can result in:
- Dehydration
- Malnutrition
- Medication overdoses
- Falls
- Infections
- Bedsores
- Pressure sores
- Skin ulcers
- Decubitus ulcers
- Osteomyelitis
- Septicemia
- Gangrene
Nursing homes must:
- Care for their residents in such a manner and in such an environment that promotes the maintenance or enhancement of the quality of life for each resident.
- Provide services and activities to attain or maintain the highest practicable physical, mental, and psycho-social well-being of each resident in accordance with a written plan of care. The plan should describe the medical, nursing, and psycho-social needs of the resident and is to be periodically reviewed and updated.
- Conduct a comprehensive assessment that describes the resident's capability to perform the daily functions and significant impairments.
